Stamp Duty Land Tax on Residential Property

This depends on the purchase price and whether
1. you are a First Timer Buyer
2. buying a second house to rent out or as a holiday retreat
3. replacing your main residence


Special provisions apply during the period 31st March 2021 to 30th June 2021 and between 1st July 2021 to 30th September 2021 and thereafter from 1st October 2021.

Joint Owners

If you are purchasing jointly with your partner or another person are you putting in the same or different amount towards the purchase price. You may require a Declaration of Trust to set out and preserve your respective contributions.
My additional fee for this will be between £100 and £150 plus VAT at 20% depending on the complexity of the document.

Time Scale

On average most transactions are completed within 2-3 months, but this may depend on circumstances outside my control. You may be purchasing an empty dwelling where the owner is now deceased. Has the deceased’s relatives obtained Probate for the deceased’s estate. You might be in a chain of transactions. Not all persons in a chain find a dwelling at the same time; different Mortgage Providers are not as quick in producing a Mortgage Offer as other providers. There may be other factors caused by other parties in the chain which are beyond my control.

LASTING POWER OF ATTORNEY

Single document £350 plus VAT at 20% plus registration fee (currently £82 No VAT payable) payable to the Office of Public Guardian, Birmingham

Husband and Wife

£500 plus VAT at 20% together also with the registration fee of £82 (No VAT payable) for each application payable to the Office of Public Guardian

It is advisable to appoint a minimum of at least two persons to act as your Attorney and depending upon the circumstances you may need to appoint others to act as  reserve. You may appoint your husband/wife or partner and other members of the family or close friends to act. You will need their authority to act because they are required to sign the relevant application form. The Power of Attorney can be brought into use immediately it is registered or at a later date should your general health deteriorate.

It may take 3 or 4 weeks for the application form to be signed by yourself and your appointed Attorneys depending on whether they attend my office to sign the document or it has to be sent to them by post. Once it has been signed by all parties it is sent to the Office of Public Guardian for registration where that process takes approximately 2 months for the Office of Public Guardian to return the registered document to me.

WILLS

Single Will - £300 inclusive of VAT at 20%
Double Will (Husband and Wife or between partners) £500 inclusive of VAT at 20%

It is advisable to appoint a minimum of two Executors to act under the terms of your Will on your death. You may appoint family members or friends and in the case of married couples and partners you can appoint each other in addition to family or friends. Whilst the proposed Executors may be willing to act now obviously they will not be called upon to act until your death. If at the time of your death they are unable to act as Executors for whatever reason the Will still remains valid.

I aim to forward to you a draft Will within 2 weeks of receiving your instructions and assuming no alterations are necessary you can then arrange an appointment to sign the final document in the presence of myself and my secretary.

MATRIMONIAL/CHILDREN MATTERS

Undefended divorce (excluding financial and other matters) £600 plus VAT at 20% and the Court fee which is currently £550 (No VAT payable).

I aim to draft application for the divorce within 14 days of receiving your instructions. Assuming there are no difficulties in affecting service of the application for a divorce upon your husband or wife one would anticipate that the Decree Nisi (which is the first stage of the divorce) will be obtained within 2-3 months. It can then be made final and absolute 6 weeks and 1 day after the Decree Nisi.

OTHER MATRIMONIAL MATTERS

Children matters are charged at an hourly rate of £200 per hour plus VAT at 20% and disbursements (e.g. Court fees, Barrister fees, and fees payable to outside Agencies and others plus any VAT which made be charged). Telephone/Letters/E-Mails sent out are charged at £20 each plus VAT at 20% whereas Incoming Letters/E-Mails are charged at £10 each plus VAT at 20%. Depending upon the specific circumstances and complexity of the proposed application I will then be a better position to give an estimate of the overall costs and disbursements of the matter.

PROBATE

It is not possible to give a precise estimate as to costs in dealing with the administration of a deceased estate. This will depend upon whether the deceased left a valid Will or the deceased died in testate (there being no valid Will). It will also depend upon the value of the assets and the variety of assets held by the deceased such as bank accounts, building society accounts, stock and shares and other investments of whatever nature. It will also depend upon whether the deceased’s home has to be sold.

It is necessary for me to write to each bank, building society and other investment organisations where the deceased held assets in order to ascertain the value of those assets at the date of death. The deceased’s home may also have to be professionally valued.

If the Client wishes to minimise some of the costs the Client can contact the deceased’s bank and other financial organisations and obtain the relevant information from them whereupon I will complete the relevant forms to obtain Probate and once Probate has been granted I will collect in the assets. The time factor will depend upon how long it takes to obtain the information from these organisations.

My normal hourly rate in dealing with obtaining of a Grant of Probate or Letters of Administration (where there is no valid Will) will be charged at £200 per hour plus VAT at 20% and disbursements which are paid to outside Agencies. Furthermore, telephone calls, letters and e-mails sent out are charged at £20 each plus VAT at 20% as in coming letters and e-mails are charged at £10 each plus VAT at 20%.

Typical disbursements for obtaining Probate/Letters of Administration are as follows:-

Probate Court fee £155 (No VAT payable)
Each additional official copy £1.50 (No VAT payable)
Land Charge Registry Searches (Bankruptcy) against each beneficiary living in this country £2.00 per person (No VAT payable)
It may be necessary to issue a Public Notice in a National or local newspaper depending upon the circumstances. This will usually cost in excess of £200 plus VAT at 20%

For a guideline I would estimate my fees as follows:-

1. The simplest estate where the Client obtains the information from the various banks and other organisations and I apply for the Grant only and the Client thereafter collects in the assets. Estimate fee £500-£750 plus VAT at 20%
2. The simplest estate where the Client obtains the relevant information from the banks and other organisations and I prepare the relevant forms and collect in the assets. Estimate £750-£1,000 plus VAT at 20% and disbursements
3. More modest estate with a number of assets but not being a complex matter. Estimate £1,000-£2,000 plus VAT at 20% and disbursements
4. A more complex estate. Estimate £2,000-£3,500 plus VAT at 20% and disbursements
5. For much larger estates with an element of estate duty. Estimate £3,500-£4,500 plus VAT at 20% and disbursements

Timescale – in normal circumstances it has been known to obtain a Grant of Probate/Letters of Administration within 2 months of receiving instructions. A simple or modest estate would take between 6/12 months to conclude once Probate has been granted and more complex cases take between 12/24 months. However, we do not live in normal times at present. During 2019 it was known for the Probate Service to take a minimum of 3 months to issue a Grant of Probate/Letters of Administration. Since the beginning of 2020 continuing to the present time, during the coronavirus pandemic Probate Service have been taking in excess of 3 months to issue a Grant of Probate/Letters of Administration. These unprecedented delays will obviously affect the overall timescale.

NOTE

If the rate of VAT on any of the above Professional Services change then the rate of VAT referred to will be adjusted accordingly. Furthermore, if any of the disbursements referred to in the above Professional Services change during the currency of a particular matter then any increased disbursements will be reflected in the final bill of costs (if any disbursements are reduced and the disbursement has not already been incurred then the reduced disbursement will be charged).

COMPLAINTS

My aim to offer my Client an efficient and effective service at all times. I hope that you will be pleased with the work that I do for you. However, should there be any aspect of my service or my bill of costs with which you are unhappy please raise your concern in the first place to me in writing. I will acknowledge your letter of complaint within 5 working days. I will then fully reply to your complaint within 14 working days. If you are not happy with the reply I will review my decision and again put in writing my final decision within 14 working days. If the complaint is not resolved at the end of the complaints process you have the right to refer your complaint to the Legal Ombudsman at PO Box 6806, Wolverhampton, WV1 9WJ Telephone No. 0300 555 0333; Website:- www.legalombudsman.org.uk. Normally you will need to bring a complaint to the Legal Ombudsman within six months of receiving a final written response from me about your complaint.
